Business
I'm also happy to offer personal advice to help you make the right choices. That's why I don't normally work through booking agencies. It also helps keep the costs down, of course.
I have good contacts with other performers, event organisers and historical re-enactors. Whether you're looking for a complete event, medieval musicians, a jester or an entire encampment, I'm happy to point you in the right direction.
CERTIFICATE OF CUNDUCT
I can provide a valid Dutch Certificate of Conduct on request.
Thinking of booking me? Just get in touch. We'll discuss the possibilities together, including availability, the type of act, fees and what you'd like me to do. You can often place a provisional booking without any obligation, giving you time to make arrangements and decide. I'll then draw up an agreement and send it to you by pigeon-mail, with all the arrangements and contact details clearly set out.
When I arrive at your event, it can be helpful to run through the final details together. During the event, I'll do my best to take as much off your hands as possible, so that you, too, can enjoy the festivities, at least when circumstances allow!
Jannes is a conjurer for good reason: he knows how to keep secrets, and your personal data is safe with him too!
GENERAL
The performer respects the privacy of website visitors, clients and other people with whom he comes into contact. The performer is the data controller responsible for the processing of personal data and can be contacted using the details provided on this website's Contact page.
The performer processes personal data only where necessary to carry out his work, maintain contact, manage bookings and payments, comply with legal obligations and ensure the website functions properly. Personal data is not sold or disclosed to third parties for commercial purposes.
CLIENTS AND CONTACT PERSONS
To carry out a booking, the performer only needs the information relevant to that purpose, such as names, addresses, email addresses, telephone numbers and details required to prepare and process invoices.
This information is used for purposes including:
-
Maintaining contact regarding the booking.
-
Preparing for and carrying out the performance.
-
Preparing and sending invoices.
-
Processing payments.
-
Maintaining financial records.
-
Complying with legal obligations.
Personal data may be stored on the performer's computer and telephone. These devices are protected by appropriate access controls, such as passwords and/or biometric security.
Where applicable, backups of administrative records are made. These may be stored on a secure external storage device and/or with an external storage provider.
The performer uses an accountant and/or accounting software for financial administration. Where these parties process personal data on the performer's behalf, appropriate arrangements are made to ensure that the data is used only for the purpose for which it was provided.
LEGAL OBLIGATIONS
The performer may disclose personal data to third parties where this is necessary to comply with a legal obligation.
For example, the performer may be required to make information from his records available to the Dutch Tax and Customs Administration or another competent public authority. In such cases, only the information necessary to meet the relevant legal obligation will be disclosed.
DATA RETENTION
Personal data is not kept for longer than necessary for the purpose for which it was collected, unless a statutory retention period applies.
For accounting records and invoices, the statutory retention period is generally seven years in the Netherlands. Records must be retained for this period where required by law.
Contact details may be retained for longer where there is a legitimate interest in doing so. This may be the case, for example, where an existing business relationship continues or where further contact or a future booking can reasonably be expected.
When personal data is no longer needed and there is no legal obligation to retain it, it will be deleted or securely destroyed.
PUBLIC EVENTS
Events open to the public at which the performer appears may be listed in the calendar on this website.
Only details about the event are included, such as its date, name and location and, where available, a link to the organiser's website. This information does not normally contain personal data. Its purpose is to inform website visitors about public performances and promote the events concerned.
Listings remain available for as long as they are relevant to the website. An organiser may object to a listing or request that it be amended or removed.
WEBSITE AND COOKIES
This website is built using Wix Studio. Wix processes certain data necessary for the operation, security and technical maintenance of the website.
Wix uses Wix Analytics to provide insight into how the website is used, for example through visitor numbers, pages visited, devices used and visitors' approximate geographical locations. Wix may use cookies and similar technologies for these purposes.
Wix may also place essential cookies required for the website to function properly and securely. The precise data collected and the technologies used depend in part on the features and settings enabled in Wix.
For more information about Wix's privacy policy and use of cookies, please consult the information provided by Wix.
RIGHT OF ACCESS, RECTIFICATION AND ERASURE
You have the right to ask which personal data the performer processes about you.
You may also request to:
-
Have your personal data corrected.
-
Have your personal data erased.
-
Restrict the processing of your personal data.
-
Object to certain types of processing.
-
Receive your data in a commonly used, machine-readable format, where the legal conditions for data portability are met.
Requests can be made using the contact details on the Contact page. The performer will assess and respond to such requests as soon as possible.
The right to erasure is not unlimited. For example, where the performer is legally required to retain certain information, it cannot be deleted immediately. Erasure may also not be possible where the data is necessary to fulfil or demonstrate an existing agreement, or to establish, exercise or defend legal claims.
COMPLAINTS
If you have a complaint about how the performer handles your personal data, you can contact him first using the details on the Contact page.
You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens), the Dutch supervisory authority responsible for data protection.
CHANGES
The performer may amend this privacy notice if his working practices, the website or applicable laws and regulations change.
The latest version of this privacy notice is available on this website.
INDEPENDENT CONTRACTOR STATUS
The performer carries out his work as a self-employed business owner. The parties expressly intend to enter into a contract for services (overeenkomst van opdracht), as defined in Article 7:400 of the Dutch Civil Code, rather than an employment contract.
The performer independently determines how the performance is carried out. The client has no authority over the artistic content or execution of the performance. The performer is free to decide on the specific details of the act and is responsible for its execution.
The performer works on his own account and at his own risk and is responsible for meeting his own tax obligations.
OPTING OUT OF THE DUTCH PERFORMERS' TAX SCHEME
Where the Dutch performers' tax scheme (artiestenregeling) applies, the parties choose to opt out of that scheme. As a result, the client does not withhold or pay employment taxes on the performance fee, and the performer is not covered by employee social insurance schemes for this work.
The performer invoices the agreed fee as a self-employed business owner. Any VAT due is shown separately on the invoice, where applicable.
ACTUAL WORKING ARRANGEMENTS
These arrangements apply only insofar as the work is actually carried out in practice in accordance with the terms set out above.
The parties acknowledge that the legal classification of their working relationship depends in part on the actual circumstances in which the work is performed.
This tax statement is based on the model agreement for an individual performer assessed by the Dutch Tax and Customs Administration (Belastingdienst), reference number 9102021566401, assessed on 22 December 2021.
The model agreement may be used until and including 31 December 2029, subject to the conditions imposed by the Dutch Tax and Customs Administration.
Here you'll find promotional text and photos for use on websites, posters, flyers and so on. All text and photos are free to use by the press and event organisers. Other parties are kindly asked to get in touch before using them.
Feel free to adapt the texts to suit your particular event, as long as the overall meaning remains intact. Don't hesitate to get in touch if you'd like to discuss anything or need help or advice.
Please make sure you choose the correct historical period. The medieval promotional photos are available in both 14th- and 15th-century versions. If you're unsure which to use, just ask!
For online use, Jannes would greatly appreciate a link to the homepage of this website. All public events are also mentioned on this site's calendar page.
Need more material or have a special request? Get in touch and we'll see what can be arranged.
the small print ;-)
These terms and conditions apply in addition to the (digital) agreement between the performer and the client, unless other arrangements have been expressly agreed in writing, for example by email.
PROMOTIONAL MATERIAL
Promotional photos and text can be found on this page. They may be used free of charge to promote an event at which the performer is appearing, provided that the original meaning and content remain intact. The material may only be used to promote the event in question, unless written permission has been granted otherwise. Exceptions, for example for educational projects, may be agreed by mutual arrangement.
PUBLIC LIABILITY INSURANCE
The performer holds public liability insurance.
PERFORMANCES IN PUBLIC SPACES
If a performance requires permits, licences or other authorisations under applicable regulations, the client is responsible for applying for and obtaining these in good time, unless otherwise agreed in writing.
The client must inform the performer in good time of any conditions or restrictions that apply to performances at the venue in question.
PARKING
Where reasonably required by the venue, the client shall provide the performer with a free parking space within walking distance of the performance location.
If free parking is unavailable, any parking charges will be reimbursed by the client, unless otherwise agreed in writing in advance.
DRESSING ROOM AND BREAK AREA
The client shall provide a secure, lockable dressing room that can also serve as a base during the event. A space of approximately 2 × 2 metres, with adequate lighting and heating if necessary, will generally be sufficient.
If such a space is unavailable — for example, at a historical encampment with period tents — the client must inform the performer in good time, and both parties will look for an alternative, such as using the performer's car.
WEATHER AND ENVIRONMENTAL CONDITIONS
In very low temperatures, parts of the conjuring act may not be possible, as cold affects the performer's sleight of hand. Strong gusts of wind and precipitation may also prevent some or all of the performance from going ahead. Adequate lighting is required, and background noise must not be excessive (normal conversation must be possible).
The performer will assess whether the act can be carried out safely and practically under the prevailing conditions. If necessary, the performer and client will work together to find a suitable alternative, such as a different location, an adapted programme or a modified performance. In practice, a workable solution has always been found in the past.
THE PERFORMANCE
The performer will do their best to contribute to the success of the event and will deliver the performance professionally.
The performer retains artistic freedom and decides how the act is performed.
The client confirms that they are familiar with the nature and style of the performance, for example through the website, having seen previous performances or having received promotional material.
BUSINESS CARDS
The performer will not actively or intrusively promote themselves during a performance.
Visitors who express an interest of their own accord may take a business card, unless the client has expressly objected to this in advance.
RECORDINGS
Visitors may take photographs and short video recordings for personal use, provided this does not interfere with the performance, the performer or other visitors.
During stage performances, visitors are not permitted to record the show on video. Flash photography is not permitted during stage performances, as it may disturb the performance or other audience members. The performer will inform the audience of these restrictions in an appropriate manner before the show begins.
The client may take photographs and short video clips of the performance, either personally or through an appointed photographer or videographer, and use them to promote the event, venue or client, including publication on websites and social media.
No separate prior permission is required for such promotional use, provided the material consists of short clips rather than a complete performance or a substantial part of the act.
The complete act, a substantial part of it, or individual sections of the act may not be published, distributed or commercially exploited as a standalone production without the performer's prior written consent.
Recordings made by or on behalf of the client may also be used by the performer for their own promotional purposes.
The use of recordings of the performer by or on behalf of third parties, other than for promoting the event in question or the client, is only permitted with the performer's prior written consent.
FORCE MAJEURE
Force majeure means a circumstance beyond the reasonable control of the party concerned that makes fulfilment of the agreement reasonably impossible.
Such circumstances may include government measures, severe weather conditions, national mourning, emergencies, war, fire, illness or other circumstances that reasonably prevent the performance from taking place.
If the event cannot go ahead due to force majeure, the client and performer will consult each other to see whether the performance can be rescheduled to another date or moved to a different location, if possible.
If the performer is unable to perform due to force majeure, they will inform the client as soon as possible. The performer will make reasonable efforts to suggest a suitable replacement of equivalent standard, where appropriate and feasible.
If the performance ultimately cannot take place due to force majeure, and the parties cannot agree on a suitable alternative date or solution, neither party will be obliged to proceed with the performance. Any costs already incurred that cannot be recovered may be discussed separately, where applicable.
CANCELLATION BY THE CLIENT
If the client cancels an agreed performance for a reason that does not fall under force majeure, the performer is entitled to charge a cancellation fee.
The amount of the cancellation fee depends on when the client cancels:
-
More than 30 days before the performance: no cancellation fee.
-
30 to 15 days before the performance, inclusive: 25% of the agreed fee.
-
14 to 8 days before the performance, inclusive: 50% of the agreed fee.
-
7 days or fewer before the performance: 75% of the agreed fee.
-
1 day before the performance, or if the performance does not take place without prior cancellation by the client: 100% of the agreed fee.
If the parties mutually agree on an equivalent replacement booking or a different date, the performer may waive the cancellation fee in full or in part.
This cancellation policy applies to both business and private clients.
CANCELLATION BY THE PERFORMER
If the performer decides not to carry out an agreed performance for a reason other than force majeure, they will inform the client as soon as possible.
The performer will make reasonable efforts to find a suitable solution in consultation with the client.
Where possible, the performer may suggest a replacement of equivalent standard. The client is under no obligation to accept the proposed replacement.
If no suitable solution can be found, any fee already paid for the performance that will not take place will be refunded.
DEVIATIONS FROM THESE TERMS
These terms and conditions may be varied by written agreement. Any such variation applies only to the specific booking concerned and does not apply to future bookings, unless the parties expressly agree otherwise.
SEVERABILITY
If any provision of these terms and conditions is found to be wholly or partly invalid or unenforceable, the remaining provisions shall remain in full force and effect. In that event, the parties shall consult each other with a view to replacing the affected provision with a valid one that reflects its original intention as closely as possible.
